7. Payment Terms

First assessment: Free for all users
Subsequent assessments: Paid unlock after question 40 (final 10 questions)
Premium features: Subscription or one-time payment as indicated

7.2 Payment Processing

12.10 LIMITATION OF LIABILITY - MAXIMUM EXTENT PERMITTED BY LAW

TO THE MAXIMUM EXTENT PERMITTED BY NIGERIAN LAW AND APPLICABLE INTERNATIONAL LAW:

GORILLA RUNNER, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

❌ ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
❌ Loss of profits, revenue, income, business opportunities, data, or goodwill
❌ Emotional distress, relationship breakdowns, employment termination, or financial losses
❌ ANY DAMAGES ARISING FROM your use or inability to use the Platform, reliance on assessment results, errors, unauthorized access, technical failures, security breaches, user conduct, third-party links, or modification/suspension of the Platform

IF GORILLA RUNNER IS FOUND LIABLE, OUR TOTAL AGGREGATE LIABILITY SHALL BE LIMITED TO THE LESSER OF:

The total amount you paid to Gorilla Runner in the twelve (12) months immediately preceding the claim, OR
₦50,000 (Fifty Thousand Naira) OR $100 USD (whichever is less)

12.14 Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS GORILLA RUNNER FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING FROM OR RELATED TO:

Your use or misuse of the Platform
Your violation of these Terms
Your violation of any laws or regulations
Your content or conduct on the Platform
Your reliance on assessment results or content
Any decisions or actions you take based on the Platform

13. Indemnification

You agree to indemnify, defend, and hold harmless Gorilla Runner, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, violation of any third-party rights, or your content or conduct.

14. Term and Termination

These Terms remain in effect while you use the Platform. You may terminate your account at any time. We may suspend or terminate your account immediately if you violate these Terms, your account is inactive for extended periods, we discontinue the Platform, or required by law.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting for non-material changes, or 30 days after notice for material changes. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

16. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any aspect of the Platform, change pricing, features, or access requirements, and remove or restrict user accounts. We are not liable for any modifications, suspensions, or discontinuations.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of Federal Republic of Nigeria, without regard to conflict of law principles. Before filing a claim, you agree to contact us to attempt informal resolution. You agree to resolve disputes individually, not as part of a class action or representative proceeding.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gorilla Runner. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not constitute a waiver. You may not assign these Terms without our consent.
